End User License Agreement

This End User License Agreement ("Agreement") is between you and the International University of Management ("IUM" or "we") for the Ombambi application (the "Licensed Application"). It is not an agreement between you and Apple. IUM, not Apple, is responsible for the Licensed Application and its content.
1. Apple App Store license
Subject to this Agreement and the applicable Apple Media Services terms and usage rules, IUM grants you a limited, non-transferable license to use Ombambi on Apple-branded products that you own or control. The license also permits use by other accounts associated with the purchaser through Family Sharing or volume purchasing where Apple permits it.
The Licensed Application is licensed, not sold. You may not sell, rent, lease, lend, redistribute, sublicense, or make it available over a network for simultaneous use by multiple devices. You may not copy, reverse-engineer, disassemble, attempt to extract source code, modify, or create derivative works except where applicable law or open-source license terms expressly permit it.
2. Updates, maintenance, and support
IUM is solely responsible for maintenance and support for Ombambi, as described in this Agreement or required by applicable law. Apple has no obligation to provide maintenance or support for the Licensed Application. We may provide updates, changes, or fixes at our discretion and may require an update for continued use of connected features.
3. Warranty and consumer rights
To the maximum extent permitted by applicable law, Ombambi is provided on an “as is” and “as available” basis without warranties not expressly stated in this Agreement. Nothing in this Agreement limits any consumer rights or warranties that cannot lawfully be limited or excluded.
If Ombambi fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price paid for the Licensed Application, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for Ombambi. Any other claims, losses, liabilities, damages, costs, or expenses arising from a warranty failure are IUM’s responsibility.
4. Product claims and intellectual property
IUM, not Apple, is responsible for addressing claims by you or any third party relating to Ombambi or your possession or use of it, including product liability, legal or regulatory conformity, consumer protection, privacy, and similar claims. If a third party claims that Ombambi or your use of it infringes intellectual property rights, IUM is solely responsible for investigating, defending, settling, and resolving that claim.
5. Data and privacy
Ombambi may process information as described in our Privacy Policy. You are responsible for the accuracy of records you enter and for maintaining appropriate backups of important offline records. Connected features may require an eligible plan, permissions, and network access.
6. External services and third-party terms
Ombambi may provide access to websites, mapping, storage, notification, payment, or other services operated by IUM or third parties. You use external services at your own risk and must comply with their terms, policies, and applicable laws. You must not use Ombambi or an external service to infringe rights, harass, abuse, threaten, defame, or upload unlawful content.
7. Legal and export compliance
You represent that you are not located in a country subject to a United States government embargo or designated as a terrorist-supporting country, and that you are not listed on a United States government prohibited or restricted-party list. You must not use or export Ombambi except as authorised by United States law and the laws of the jurisdiction where you obtained it.
8. Termination
This Agreement continues until you or IUM terminate it. Your rights end automatically if you materially breach this Agreement. On termination, you must stop using Ombambi and delete copies in your possession, except where retention is required by law or reasonably necessary for records, security, or dispute resolution.
9. Limitation of liability
To the maximum extent permitted by applicable law, IUM will not be liable for indirect, incidental, special, consequential, exemplary, or punitive loss, including loss of data, profits, or business interruption, arising from your use of or inability to use Ombambi. Nothing in this Agreement excludes liability that cannot legally be excluded or limited.

11. Apple as third-party beneficiary
You and IUM acknowledge and agree that Apple and Apple’s subsidiaries are third-party beneficiaries of this Agreement. When you accept this Agreement, Apple will have the right to enforce it against you as a third-party beneficiary.
12. Governing terms
This Agreement supplements the Ombambi Terms of Use. If a provision of this Agreement conflicts with mandatory law, that provision will be applied only to the maximum extent permitted, and the remaining provisions will continue. Any dispute will be handled under the applicable laws and courts of Namibia, except where mandatory consumer law provides otherwise.
